Terms of Service

Please read these Terms carefully before using UnMedIQ. By creating an account or using our service, you agree to be bound by these Terms.

1. About UnMedIQ

UnMedIQ is a prescription management software designed exclusively for registered medical practitioners in India. It provides a digital workspace for writing, saving, and printing outpatient prescriptions.

UnMedIQ is not a healthcare provider, medical device, telemedicine platform, or clinical decision support system. It is a documentation and workflow tool.

2. Eligibility

To use UnMedIQ, you must:

  • Be a medical practitioner registered with the National Medical Commission (NMC) or equivalent State Medical Council under the National Medical Commission Act, 2020.
  • Use the service only for lawful medical practice within the scope of your registration.
  • Be at least 18 years of age.
  • Provide accurate registration details during sign-up.

We reserve the right to suspend or terminate any account if we have reason to believe the above conditions are not met.

3. Account Responsibilities

  • You are responsible for maintaining the confidentiality of your account credentials.
  • You must not share your account with any other person, including staff or colleagues.
  • You are fully responsible for all prescriptions and records created under your account.
  • You must notify us immediately at support@unmediq.com if you suspect unauthorised access to your account.

4. Clinical Responsibility

UnMedIQ does not prescribe, recommend, or validate medicines.All clinical decisions — including diagnosis, medicine selection, dosage, and instructions — are made solely by the treating doctor and are the doctor’s full professional and legal responsibility.

UnMedIQ is a documentation tool. It does not check for drug interactions, contraindications, or clinical appropriateness. The treating doctor must exercise independent clinical judgment at all times.

Prescriptions generated through UnMedIQ must comply with all applicable laws, including the Drugs and Cosmetics Act, 1940, NMC Code of Medical Ethics, and any applicable State regulations on e-prescriptions.

5. Patient Data and Consent

You, as the treating doctor (Data Fiduciary under the DPDP Act, 2023), are responsible for:

  • Obtaining valid, informed consent from patients before entering their personal and health data into UnMedIQ.
  • Ensuring that patients are aware their data will be stored digitally.
  • Complying with all applicable data protection laws, including the DPDP Act, 2023, and IT Act, 2000.

UnMedIQ records a digital consent timestamp with each prescription you save. This is an audit record of your attestation — it does not substitute for the doctor’s responsibility to actually obtain patient consent.

6. Acceptable Use

You must not use UnMedIQ to:

  • Issue prescriptions for controlled substances in violation of applicable law (NDPS Act, 1985).
  • Enter false, fabricated, or misleading patient information.
  • Attempt to gain unauthorised access to another doctor’s data.
  • Use the platform for any commercial purpose other than your own medical practice.
  • Reverse-engineer, scrape, or attempt to extract the underlying database or source code.
  • Use automated bots or scripts to interact with the service.

7. Subscription and Pricing

UnMedIQ may offer free and paid tiers. Current pricing is displayed on the login page and within your account settings. We reserve the right to change pricing with 30 days’ notice. Continued use after the effective date constitutes acceptance of the new pricing.

Paid subscriptions are billed in advance. Refunds are governed by our Refund Policy, available at /refund.

8. Data Ownership and Export

You retain full ownership of all patient data and prescriptions you create on UnMedIQ. We do not claim any rights over your data.

You can export all your data at any time from the Settings page. Upon account deletion, you will receive a data export link valid for 30 days before permanent deletion.

9. Service Availability

We aim for high availability but do not guarantee uninterrupted service. UnMedIQ is not intended for use in emergency or critical care settings where system downtime could be life-threatening. You should maintain an offline backup procedure for such scenarios.

10. Limitation of Liability

To the maximum extent permitted by applicable law, UnMedIQ and its operators shall not be liable for:

  • Any clinical outcome, medical error, or adverse event arising from prescriptions issued using this platform.
  • Loss of data due to circumstances beyond our reasonable control.
  • Indirect, incidental, or consequential damages.

Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim.

11. Indemnification

You agree to indemnify and hold harmless UnMedIQ and its operators from any claims, losses, or damages (including legal fees) arising from: (a) your use of the service; (b) your breach of these Terms; (c) any prescriptions you issue through the platform; or (d) your violation of any applicable law or third-party right.

12. Termination

You may delete your account at any time from Settings. We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law.

13. Governing Law and Disputes

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts of Mumbai, Maharashtra.

Before initiating legal proceedings, we encourage you to contact us at support@unmediq.com to resolve disputes informally within 30 days.

14. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated by email and by a notice on the UnMedIQ login page at least 15 days before taking effect. Continued use of UnMedIQ after that date constitutes your acceptance.
